The site allows Fishclub to offer for sale clothing products and accessories (“products”) to Internet users sailing on the site (hereinafter the “Customer”).

The production being limited, if the customer buys a product in stock, he recognizes that he can not change size or model after reception. If the Customer wishes to be reimbursed for an order placed in stock and in fact the request, the reimbursement procedure will be initiated immediately after receipt of the returned item.

Any order or pre-order (hereinafter the "orders" or "pre-orders") of products appearing on the site supposes the prior consultation of these general conditions (the "CGV") and their acceptance without reserve and irrevocably.

2. Products

In accordance with article L. 111-1 of the Consumer Code, the company FISHCLUB presents on the site the products for sale and their characteristics. The customer has the possibility of knowing, before taking the final order, the essential characteristics of the products he wishes to buy.

The stock offers presented by the company Fishclub are only valid within the limits of available stocks.
The photos representing the products have only an indicative value. These photos, as well as the texts illustrating the products, do not fall into the contractual field.

 

3. Price

The prices appearing on the site are indicated in euros including tax and are only valid on the date of validation of the order by the customer. The company FISHCLUB reserves the right to modify them, without notice, at any time, which remains that the invoicing of the products will be done on the basis of the prices in force at the time of the registration of the order or the pre -order.
The prices do not take into account the delivery costs, billed in addition and indicated before the validation of the order or pre -order. The prices take into account the T.V.A. applicable on the day of the order or pre -order and any change in the applicable rate of T.V.A. will be automatically reflected in the price of the products appearing on the site.

Payment of the entire price must be made when ordering or pre -order. At no time can the sums paid be considered as deposit or deposits. These prices are guaranteed subject to typography or printing error.

The price of products sent outside the European Union and DOM-TOM will be calculated excluding taxes. In this case, the customer is considered to be the importer of the products. 4. Payments

The products are payable in euros on the day of the effective order.

To pay his order, the Customer has more means of payment. The following: Sripe and Paypal with online payment through their bank card site.

For payment by credit card, the customer communicates the number of his bank card, associated with his expiration date as well as the figures for the cryptogram appearing on the back of his bank card. In order to ensure the safety of payments made online, the customer accesses a dedicated space made available by the company Stripe, which provides security and registration of the payment order and the security of payment in itself .

In this regard, the Customer expressly recognizes that the communication of his bank card number at the company Fishclub through the company Stripe applies to the debit authorization of his account up to the products ordered.

The accepted cards are: Visa, Mastercard, American Express, Discover, Diners Club, JCB.
 
Whatever the means of payment used, the company FISHCLUL is responsible for occasional banking costs generated by payment, within the limits of management fees billed by Stripe. All payment is made via Stripe.
Any other fees, whatever the reason, will be invoiced to the Customer or paid directly by him as during a payment via Paypal.

Fishclub reserves the right to suspend or cancel any order or pre -order and any delivery in the event of refusal of authorization to pay by bank card from officially accredited organizations or in the event of non -payment.

Fishclub reserves in particular the right to refuse to make a delivery or to honor an order or pre -order from a Customer who has not completely or partially set a previous order or with whom a payment dispute would be in progress.

The goods delivered remain the ownership of the company FISHCLUB until the receipt of payment. The transfer of risks to the customer takes place upon delivery of the products.
Computerized registers, kept in Fishclub IT systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.
The archiving of order orders and invoices is made on a reliable and durable support that can be produced as proof.

Payment in several times with Paypal. If you pay your order in several times, you accept the PayPal customer general conditions. In particular, you can only pay in several times purchases, the amount of which is defined by Paypal. The costs applicable to this payment means are defined between the Customer and Paypal.

 

5. Orders and pre -orders

Any order or pre -order will be confirmed when the customer clicks on the "Place my order" button.
Confirmation of the order or pre -order implies acceptance by CGV customer and essential characteristics of products.

As soon as the order is registered or pre-order, a confirmation email summarizing it (products, prices, availability of products, quantity, etc.) will be sent to the customer by Fishclub. To this end, the Customer formally accepts the use of email for confirmation by Fishclub of the content of his order. In any event, invoices are given during delivery.

If the product is in stock, the order will be executed at the latest within 7 days from the day following that when the customer placed his order. In the event of unavailability of the ordered product, in particular due to suppliers, the customer will be informed as soon as possible and will have the possibility of canceling his order. The customer will then have the choice to request the exchange of the product within fifteen (15) days at the latest after receipt or to be reimbursed.
The refund will be made at the latest within fourteen (14) days of the cancellation of the order.

 

6.Livration

6.1 Delivery location

Delivery is made to the delivery address indicated by the Customer, it being specified that it must be the customer's residence address or any other natural person of their choice, if this is clearly specified when ordering or Pre -order.
Delivery cannot be made either in hotels or in postal boxes.

When registering the customer's personal contact details, the latter must ensure the accuracy and completeness of the compulsory data he provides.
In the event of an error in the wording of the recipient's contact details, Fishclub cannot be held responsible for the impossibility of delivering the product (s).

6.2 Delivery times

Delivery times are indicated when ordering. These are indicative deadlines, expressed in working days and corresponding to the average processing and delivery deadlines.
Fishclub cannot be held responsible for the consequences due to a delay in routing not being its fact or being due to an act of force majeure.

6.3 Reception of products

Delivery is deemed to be made upon handing over to the customers by the carrier, materialized by the control system used by the latter.
Upon receipt of the products, the Customer is required to check the condition of the goods packaging and report the damage due to the carrier on the delivery slip, as well as Fishclub, within three (3) days by sending an email to contact@fishclubparis.com or by sending an email to the contact form on our site.
The customer can, at his request, obtain the sending of an invoice to the billing address and not to the delivery address.
Delivery costs are to be paid by the customer in France and worldwide. The return costs will be borne by Fishclub in the event of a return for lack of compliance, except when the delivery address is not located in France. We take care of the return costs if necessary in France but they are the responsibility of our international customers, except in the case of the non-compliance of a product, in which case we take care of the costs of return ports.

 

7.

Fishclub responds to existing compliance defects when the product is issued under the conditions of articles L. 217-4 and following of the Consumer Code.

When it acts as a legal compliance guarantee, the customer:
-benefits from a period of two years from the delivery of the product to act.
-can choose between repair or replacement of the property; in accordance with article L. 211-19 of the Consumer Code, Fishclub cannot however proceed according to the customer's choice if this choice results in a manifestly disproportionate cost with regard to The other modality, taking into account the value of the property or the importance of the defect. The Customer may decide to implement the guarantee against the hidden defects of the thing sold within the meaning of article 1641 of the Civil Code, which make it unfit for the use to which it is destined, or which decreases this use so much that 'Buyer would not have acquired him, or would have given only a lower price, if he had known them.  In this case, he may choose between the resolution of the sale or a reduction in the sale price in accordance with article 1644 of the Civil Code.
The action resulting from crippling vices must be brought by the customer within two years from the discovery of the defect.

 

8. Right of withdrawal

Pursuant to articles L.221-18 and following of the Consumer Code, the Customer has a period of fourteen (14) free days from the date of delivery of the order to assert their right of withdrawal on his
Order.
This period runs from receipt of products by the customer.
The Customer must attach to his request for withdrawal a copy of the invoice or any other element to identify the order in question, and its holder.
Only the customer identified as such with Fishclub can exercise this right, excluding any other person, and in particular the recipient of delivery (for example in the event of a gift).

 

9. Return and reimbursement methods

Any exchange or return must be subject to a customer declaration to Fishclub, via the site's contact form.
The products must be returned by the customer at the latest in the fourteen (14) days of the communication of his decision to retract.
The product must be returned by the customer in its original packaging or any equivalent packaging and in perfect condition (allowing a recommerition, having been neither worn nor washed), to request the exchange, reimbursement or have a credit Without penalty.
If the package is lost or damaged during the product return, the cost of the damage is the responsibility of the customer

In accordance with article L. 221-24 of the Commercial Code, Fishclub undertakes to reimburse the sums collected under the order or pre-order within fourteen (14) days. This period runs from the first of the following two dates: (i) the receipt by fishclub of returned products or (ii) the receipt by fishclub of proof of the shipment of the products by the customer.
The refund will be made by credit on the bank account of the customer corresponding to the bank card used to pay the order or pre -order. If you have changed bank accounts, remember to give your new bank details to your former bank.

 

10. Applicable law

These general conditions are subject to French law. In the event of a dispute or complaint, the customer will primarily aim at Fishclub to obtain an amicable solution.
The customer is informed that any consumer can use a consumption mediator for free for the amicable resolution of a dispute with a professional. Consumer mediation applies to any national or cross -border dispute between a consumer and a professional as part of the execution of a sales or service contract.

The request cannot be accepted by the consumption mediator if:
1 ° The Customer does not justify having attempted, beforehand, to resolve his dispute directly with the company FISCHCLUB by a written complaint according to the procedures provided;

3 ° The dispute was previously examined or is being examined by another mediator or by a court;
4 ° The consumer submitted his request to the mediator within a period of one year from his written complaint with the company Fishclub;
5 ° The dispute does not fall within its field of competence.
The consumer is informed by the mediator, within three weeks of receipt of his file, of the rejection of his mediation request.
In the absence of recourse to mediation, the courts of the jurisdiction of the company's headquarters will be competent.

 

11. IT and freedoms

The customer information and data is strictly necessary for order management, execution and monitoring of commercial relations, as well as internal statistical purposes.

The Customer has at any time a right of access, rectification and opposition to personal data concerning him, under the conditions provided for by the law of January 6, 1978.
